Suo Moto contempt was proceeded against a witness for making false statement under oath in Gokulraj Murder case by Madras High Court

In this case Swathi was the star witness of the gokulraj murder case which was happened in 2015. Against Swathi Madras High Court initiated contempt proceedings against her. This case was State V/S Yuvraj and Others [Crl.A(MD)Nos.228,747,515,230,232,233 and 536 of 2022]. The Case was presided by a divison bench of justices M.S. Ramesh and N. Anand Venkatesh.

Facts of the case

  • Gokulraj, a Dalit youth who was 21 year old the time of death was abducted from Tiruchegode Arthanareeswarar temple on June 23, 2015. The very next day his body was found with his head severed. It was later found that Gokulraj was killed by members of a fringe outfit for having a relationship with an upper caste women.
  • A special court in Madurai had found that yuvraj, leader of Dheeran Chinnamalai Peravai as the prime accused and convicted him along with Nine others with the life imprisonment in March 2022.
  • While hearing the appeal challenging the conviction madras High Court summoned Swathi. While showing the video to her of the CCTV footage in which she and Gokul were shown coming out of the temple. Though she recognized the men as gokul but she refused to recognize the women as herself. The court however observed that she was making false statement.

JUDGMENT

Though the court had warned earlier that contempt proceedings will be initiated for such acts, still Swathi stood by her statements. Due to this court initiated the comtempt proceedings against Swathi.
