After doing 3 year Diploma/Polytechnic after class x are eligible for BALLB admission said by Madras High Court to The Tamil Nadu Dr. Ambedkar Law University

In this case Madras High Court directed the Tamil Nadu Dr. Ambedkar Law University to permit the students who have 3 year diploma/polytechnic degree after 10th to participate in the admission process for the 5 years BALLB course. The case was S. Karthi V/S The Registrar, The Tamil Nadu Dr. Ambedkar Law University [2022(Mad)524][Case No: W.P.18822 of 2022]. The case was presided by Mr. Justice CV karthikeyan of Madras High Court.

Facts of the case

  • The writ petition was filed by the petitioner under Article 266 of the Constitution of India praying to issue a writ of Certiorarified Mandamus about the admission notification for 5 year integrated law degree course for the academic year 2022-2023 dated 11.07.2022 issued by the registrar and to permit him to participate in the selection process for 5 year BALLB course at the affliated colleges to The Tamil Nadu Dr. Ambedkar Law University.
  • The petitioner after completed 10th did 3 year diploma course and after that he wants to join a law course.
  • In the connection of this case a circular of Bar council must be seen in here which is as follows, “Sir/Ma’am(s), This is to bring to your kind knowledge that the Legal Education Committee of the Bar Council of India has considered the Orders dated 23.03.2021 passed by the Hon’ble High Court of Madras in W.P.No.7665 of 2021 and in W.P.No.10646 of 2021 vide dated 27.04.2021. https://www.mhc.tn.gov.in/judis 4 After consideration, it is resolved that the 3 year diploma / polytechnic course issued by an institution recognized by the Government shall be considered at par with +2 certificate for the purpose of admission to the 5 year integrated L.L.B. Degree Course. You are all required to kindly implement the same. This is for your kind information and necessary compliance.”
  • This circular by Bar Council of India was quite self explaintory that who can participate in the admission process for 5 year integrated course and who cannot and it is clear that petitioner was was eligible for admission process.

JUDGMENT

The Madras High Court gives the direction to the respondent to permits the petitioner to participate in the admission process. He is eligible for 5 year BALLB course , in accordance with other rules and regulation and he cannot be merely get disqualified on the basis that he had studied 3 year diploma course, after completing the 10th standard.
