The State of Tamil Nadu Government was directed by Madras High Court to pay Rs. 1 lakh as compensation to the family of the bangle seller as he went missing after his hospitalization during Covid-19 in 2020

The petition was of Habeas corpus. In this case the petitioner father who was bangle seller who went missing during Covid-19 2020 after being hospitalized. The case was Thulasidass Adikesavan VS The Inspector of Police & The commissioner corporation of Chennai (HCP No. 1149 of 2020). The case was presided by The Hon’ble Mr. Justice P.N. Prakash & The Hon’ble Mr. Justice N.Anand Venkatesh in Madras High Court.

Facts of the case

  • In this case Adikesavan, who was 72 years old in 2020 on 9 June 2020, was taken by the greater Chennai corporation authorities to Ekkattuthangal urban primary health centre. On June 11, 202 he was referred to government hospital for treatment and since Adikesavan was not carrying any mobile phone his family lost his track after that. Later, when his family when tried to find him in both the hospitals the couldn’t find him.
  • After that Adikesavan’s younger son tried to file a police complaint for the missing person the St. Thomas Mount police Station refused to do so. The family said that after that they were made to run from building to building. After many request police filed the FIR of missing person.
  • The habeas corpus petition was filed by the victim family in Madras High Court on July 2, 2020 and the court was told about the facts as stated above.

JUDGMENT

The court said that the state government and the hospital authority are only trying to save the people from the virus and we can’t blame them for that. Although court also said that it would have been better if the concerned police could have taken the action on time. Court said that it is not necessary to be too harsh on the state government so, court directed to the state govt. to pay compensation of Rs.1,00,000/- to the missing person’s family.
