Demolition Action Stayed : Bombay High Court

The Bombay High Court granted interim protection to slum dwellers against demolition orders issued by the Slum Rehabilitation Authority, while citing ongoing Ganesh Chaturthi celebrations in Mumbai under the learned bench of  Justice Sandeep K. Shinde in the case of Deepak Vithal Adhav & Ors. v. State of Maharashtra & Ors (WRIT PETITION (L) No. 27400 OF 2022)

FACTS OF THE CASE

The Petitioners i.e. Slum dwellers were apprehending that the demolition of Notice structures/huts, occupied by them, they have moved High Court for the protective order. 

OBSERVATION OF THE COURT:

The Court looking into the facts of the case ordered that since Ganesh Chaturthi is celebrated widely in Mumbai, authorities shall not take any coercive action, in respect of notice structures, till 24th September, 2022. The Court further expounded that the Court has not heard the Petitioners on merits but for the reasons stated above, time being protection has been granted.

The court further clarified that it has not heard the petitioners on merits but time being protection has been granted for the aforementioned reason.
