INTRODUCTION
As petitioner have filed the present application challenging the order passed by the Principal secretary, Education Department of Government of India,claim of the petitioner for absorption/regulazation on the post of Lok shikshak has been rejected.
FACT
As per the facts petitioners were appointed as Lok shikshak for 11 months in contractual basis in year 2003.As shiksha Mitra been absorbed as panchayat Teacher after coming force of Bihar Panchayat Elementary Teacher (Employment and service conditions) Rule 2006 but the petitioner has not been considered for the absorption/ Regularisation.As on 19/12/2013 petitioner claim regulazation/ absorption in the co-ordinate bech where it was rejected and now the writ application has been filed after six years for seeking absorption/regulazation as Panchayat teacher relying upon the judgement passed by a co- ordinate Bench.
THE COURT ANALYSIS AND DECISION
As per the Hon’ble court after view of the submission made by the parties and the fact that claim absorption of the petitioners The court considered that now Bihar Panchayat Elementary Teacher (Employment and Service conditions) Rule 2023 has come into force for appointment of Teachers on regular basis through competative exam so no relief can be granted to the petitioner and the present writ application is accordingly dismissed.
