Property of Institute on sale on account of non payment of salary to employees: Punjab High Court.

The Punjab High Court, in Ajit Singh and other v/s State of Punjab (CWP No. 2786 of 2023 (O&M), on 20th April, 2023, held that Baba Hira Singh Bhattal Institute of Engineering and Technology’s property to be disposed for payment of salary to its employees. The judgement was presided by Honourable Mr. Justice Anil Kshetarpal.

FACTS OF THE CASE:

The employees of Baba Hira Singh Bhattal Institute of Engineering filed a writ petition on account of non-payment of salaries since December 2019. The officials of the aforementioned institute had ceased to respond to the telephonic calls of the respondent. The learned counsel for the institute contended that efforts were undertaken by the institute for the payment of the pending salaries.

JUDGEMENT:

It was observed by the Court that the nature of Institute was autonomous and the Chairman and members were nominees of the State Government. The Court contended that it is left with no choice other than directing the Board of the Governors of the Institute to dispose of the property in order to pay the pending salaries within a duration of one month. It was also noted that claim by the employees for their salaries was their preferential right.
