Bail denied to woman on false rape allegations: Punjab High Court.
The Punjab High Court, in ABC v/s State of Haryana (CRM-M-33585-2022 (O&M), delivered on 7th December, 2022, denied bail to a woman who was accused of repeatedly filing false rape allegations. The judgement was presided by Honourable Mr. Justice Ashok Kumar Verma.
FACTS OF THE CASE:
Under Section 439 read with Section 438 CrPC, 1973, the petitioner contested for bail. The petitioner was friends with the complainant, who registered the FIR. The complainant accused the petitioner of trying to perform obscene activities with her son, who denied the same. Thereupon, the petitioner blackmailed the son of a false rape case and mentioned that she had earlier sent boys to jail upon the same complaint. The respondent’s son was repeatedly harassed by the complainant through repeated phone calls and threats. Further, the petitioner along with her mother and another man and demanded money for settlement or threatened of filing a rape case. Learned counsel for the petitioner submitted that the petitioner was forcefully raped by the complainant’s son, under the pretext of marrying her and took undue advantage of their friendship.
The court took in observation that 9 FIRs had been filed by the petitioner between September 2020 and November 2021. The petitioner was habitual in fi,I got complaints against young boys and their family members. It was also held by the court that the petitioner was running a false racket for extortion of money from the person against whom the allegations have been made by her.
