Patna High Court granted bail to the chief accused of supporting Nupur Sharma “Prophet Remark” who is chief of “Hindu Putra Sangathan” named Rajeev Kumar Brahmarshi. Nupur Sharma was a former Spokesperson of BJP. The case was Rajeev Kumar Brahmarshi V/S The State of Bihar CRIMINAL MISCELLANEOUS No.43966 of 2022. The case was presided by HONOURABLE MR. JUSTICE SHAILENDRA SINGH.

Facts of the case

  1. An objectionable video was uploaded by the petitioner on a social media platform against the Muslim religion which hurts the sentiments of the community and could lead to disturbances in social harmony.
  2. He was booked under Section 295A and 153A of the IPC and Section 67 of the I.T. Act.
  3. The counsel of the petitioner said that the matter against him was lodged in a haste manner by the police officer himself on the same date on which the video was uploaded. It was also submitted that the petitioner was contesting for nagar nigam election so several political parties have a rivalry with him, and he is being framed in criminal cases.


The court observed that the case was only on the objectionable content being shared by the petitioner and FIR is on disturbances of communal harmony due to the post. It is not like someone came to the police and complained against the petitioner that he was hurt due to the post. The court granted the bail to the petitioner on Rs.10,000/- bail bond with two sureties.
