Madras High Court directs the state to constitute task force for effective implementation of post matric scholarship scheme for SC/ST students

In this case , the court asked the state authority to consider for constituting a task force with representatives from both union government and state government ministries for the post matric scholarship scheme for SC/ST students. The case was P. Vedachalam V/S The principal secretary, Adi Darvidar and and Tribal Welfare Department and another. [(Mad) 521, 2022][Writ Petition (MD) No. 22410 of 2016 and W.M.P. (MD) No. 16044 of 2016]. The case was presided by THE HONOURABLE MR. JUSTICE R. MAHADEVAN and THE HONOURABLE MR.JUSTICE J. SATHYA NARAYANA PRASAD. 

Facts of the Cases

  1. The petitioner has filed this writ petition, as a pro-bono publico, praying to issue a writ of mandamus directing the respondent to act accordingly as per the govt. orders and to disburse the post matric scholarship to SC/ST/SCA students of all colleges in Tamil Nadu at the beginning of every acdemic year.
  2. As per the Govt. order the Post-Matric Scholarship scheme, financial assistance is given to Adi Dravidar and Tribal students, who continue their studies from XI standard and whose parent or guardian’s annual income does not exceed Rs.2.50 lakhs. Further, an assistance of Rs.230/- to Rs.550/- per month is given as maintenance allowance for day scholars and Rs.380/- to Rs.1,200/- per month as maintenance allowance for hostelliers depending upon the class in which they study. That apart, for the students who got admitted in the free seats meant for Schedule Caste/Schedule Tribe in the self-financing colleges, scholarship is being given to pay the fee, as determined by the Fee Determination Committee constituted by the Government.
  3. The petitioner said that due to delay in the disbursement of the scholarship amounts, several students- who are admitted in schools on the free seat faces problems in continuing their students.

JUDGMENT

The court said that the late disbursal of the scholarship scheme defeats the constitutional purposes for which the Post-matric scholarship scheme has been formulated. The court directs the state to constitute a task force for the effective implementation of Post- Matric scholarship scheme for SC/ST/SCA.
