Facts of the case

An appeal was presented by the state of karnataka represented by its secretary, dept. of revenue m.s. building, bengaluru-1.and the assistant commissioner and land acquisition officer, dharwad sub-division, dharwad.against dyamanna s/o brahmanand badiger, age:59 years, occ:agriculture r/o: kusugal, tq: hubballi, dist: dharwad   the deputy chief engineer, construction south-WESTERN, RAILWAY, hubballi.

This MFA is submitted according to § 54 paragraph 1 plot charging act, 1894, prayed to stay judgment and the award was given by the iii additional senior civil

JUDGEMENT

The Judge MR JUSTICE R. NATARAJ observed that it is stated that the appeal filed by the recipient in MFA No. 100848/2016 against the same resolution issued by the reference court was rejected. In view of the matter, there is no need to interfere with the contested judgment and finding issued by the referring court. The appeal is therefore without merit and is dismissed.
