High Court Directs Centre, KVS To Sanction Posts Of 987 Special Educators In Kendriya Vidyalayas across country- Delhi High Court

The Delhi High Court has directed the Union Government and Kendriya Vidyalaya Sangathan (KVS) to sanction the posts of 987 special educators for catering for the needs of special children. This SOCIAL JURIST, A CIVIL RIGHTS GROUP v. KENDRIYA VIDYALAYA SANGATHAN & ANR [W.P.(C) 5916/2022], which was presided over by division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad.

FACTS OF THE CASE

 

A Public Interest Litigation [PIL] was filed by Social Jurist, a civil rights group, regarding appointment of special educators in KVS schools for children with special needs.

The Counsel appearing for KVS presented a report showing all the KV’s running across the country along with the number of special educators required to be appointed to cater to the needs of special children. KVS has already engaged 40 special educators on contractual basis and the total number of special educators who are yet to be engaged is 987, for which posts are to be created.

Counsel representing for the petitioner asked the court to mandate the same in all schools across the country and appointment of special educators in exercise of powers under Section 20 of the Right of Children to Free and Compulsory Education Act, 2009.

JUDGEMENT OF THE CASE

 

The court directed KVS to file an affidavit disclosing the particulars of the special educators who have been appointed, along with particulars of the school and number of schools for whom they have appointed.
