Karnataka high court grants anticipatory bail to bhavani revanna in kidnapping case amid allegations of non-cooperation and media trial

BACKGROUND

On May 2, 2024, a complaint was filed at K.R. Nagara Police Station by an individual whose mother had worked for Accused No.1, H.D. Revanna, for six years before leaving the job to become a daily wage labourer. Days before the Parliamentary Elections, Accused No.2, Satish Babanna, who was acquainted with the family, visited their home and asked the complainant’s mother to accompany him. She returned on the election day. On April 29, 2024, Satish Babanna came again, claiming she was needed due to a lodged case. She left with him but did not return. The next day, the complainant learned of a viral video showing the sexual assault of his mother. When he confronted Satish Babanna, he refused to return his mother. Fearing for her safety, the complainant filed a report, leading to the registration of an FIR. The petitioner contended that although she was not arraigned as accused in the FIR, it is circulated in the print and electronic media that she has been issued with notice for appearance before the Investigating Agency and same has caused serious apprehension in her mind that the Investigating Agency would take her into custody due to political vengeance and also with an intention to humiliate and tarnish her image in the society and this apprehension has caused her to file a anticipatory bail petition in the High court as the Special Court of Sessions for criminal cases related to present and former MPs and MLAs in Karnataka on June 1 declined to grant anticipatory bail, by observing that there is a prima facie case to show that “Ms. Bhavani had played a specific overt act” in the abduction of the woman.

UPDATE

The Karnataka High Court today granted anticipatory bail to Bhavani Revanna, Prajwal Revanna’s mother, who has been charged with kidnapping a woman by a single judge bench of Justice Krishna S Dixit emphasizing the protection of women from unnecessary custody, noting Bhavani answered all police questions but was accused of non-cooperation by the state. Bhavani is barred from entering Mysore and Hassan except for investigation purposes, and the court cautioned against a media trial. The court’s interim protection order from June 14 continued. Special Public Prosecutor Ravivarma Kumar argued for cancelling interim bail due to Bhavani’s alleged non-cooperation and a non-bailable warrant against her. Bhavani’s lawyer, C V Nagesh, argued that custodial interrogation could have occurred earlier and questioned the police’s procedures. The prosecution accused Bhavani of masterminding the abduction to protect her son. The court reserved its order for deeper consideration, noting the complexity of the case.
