Abstract
One of the most emerging industries in the current scenario is artificial intelligence where it is not only limited to scientific purposes but also it’s applicability has been viding overa period of time.as one of the technology is Deepfake AI which is to create audio ,video and image hoaxes.As Deepfake i.e Deeplearning and fake are AI generated that have been digitally replaced one person face ,voice to another person.As there are Advantages and Disadvantages of the technology.so it depends on the society either to use as a advantage or disadvantage.
Introduction
Recently There was a controversy of Actress who has been prey of Deepfake and was circulated online even there are videos and which are been made by Deepfake for the advertisement etc.As Deepfake are good for entertainment, education etc but can damage someone reputation,fake news etc.
What is Deepfake
A Deepfake refers to digital media which may be of either audio,video or image created through a artificial called Deeplearning that have been edited and manipulated using Artificial intelligence.As In the year 2017 where one of the user of Reddit pronounce himself Deepfake where he used to upload video or audio post manipulated explict video of celebrities and now in present year Deepfake technology with the help of AI tools allows semi & unskilled individuals to create false or fake content with morphed audio- visual clips & images.
Working technology for Deepfake
As Deepfake uses two Algorithms- a Generator and a discriminator which combines the technology together and create a Generative Adversarial Network (GAN) .As GAN uses a deep learning to recognise patterns in real images and then uses those patterns video uses the original video or images and made it to say or do things which they have never did or swap the images or video of an any individual into any video of any other individual.
As there are technologies which make Deepfake easier ,more accurate and to enhanced the technology as they are:
GAN i.e Generative Adversarial Network which is used to develop all Deepfake contents.
CNN i.e Conventional Natural Network which are used for facial recognition and movement tracking
NLP i.e Natural Language Processing used to create a fake audio
HIGH – Performance computing who h provides significant necessary computing power
Advantages & Disadvantage
There are Advantages and Disadvantages of Deepfake technology are-
ADVANTAGES
As Deepfakes technology are best for entertainment.
As Deepfakes technology can be used in education.
As Deepfakes technology can be used to raise awareness of social issues
It also help in to Generate the historical picture of our warriors
DISADVANTAGE
Deepfake can be used for fake news.
It can be used in Money Laundering
It can be used to Damage someone reputation
It can steal the identity of the person
How to recognise Deepfake
As Deepfakes can be recognised-
By looking into the eye movements were it can be noticed of unnatural movement or unnatural blinking patterns.
Difference in light & colour of image of the fake picture
Mismatching in the voice & lip movement
Law and Rules in India for Deepfake
As there are no proper rule & regulations or any law in India but there are laws which are somehow related to it-
SEC 66E of the IT Act,2000 states that Whoever, intentionally or knowingly captures, publishes or transmits the image of a private area of any person without his or her consent, under circumstances violating the privacy of that person, shall be punished with imprisonment which may extend to three years or with fine not exceeding two lakh rupees, or with both.
Example-publishes means reproduction in the printed or electronic form and making it available for public;
Sec 67,67 A of IT act 2000,prohibit and prescribe punishments for publishing or transmitting obscene material, material containing sexually explicit act and children depicted in sexually explicit act in electronic form respectively.
Sec 500 of IPC , punishment for Defamation which states that whoever defames another shall be punished with simple imprisonment for a term which may extend to two years, or with a fine, or with both
Cases related to it :
a)Anil Kapoor v. Simply Life India and Others where the Delhi High Court granted protection to actor’s, individual persona, and personal attributes against misuse, specifically through AI tools for creating Deepfakes. The Court granted an ex-parte injunction that effectively restrained sixteen entities from utilizing the actor’s name, likeness, image and employing technological tools such as AI for financial gain or commercial purpose.
b)Amitabh Bachchan v. Rajat Negi and Other (2022) was granted an interim in rem injunction against the unauthorized use of his personality rights and personal attributes such as voice, name, image, likeness for commercial use.
CONCLUSION
As the Development and use of Deepfake is a global issue for the present.As they will increase in prevalence and quality over the next few years which doesn’t mean that we can trust any video or audio but should be carefull or aware with the fake image, video or audio. As increase in Deepfake technology there should be a strict law or rule relating to Deepfake technology for the protection of an individual.
