FACTS

The petition under section 438 of Cr.P.C., praying that in the circumstances stated in the grounds filed in support of the Criminal Petition, the High Court may be pleased to grant Anticipatory Bail to the petitioners in the event of Arrest. This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (CrPC), was filed by the Petitioners in Crime No.8 of 2023 of Chillakallu Police Station, NTR District, registered for the offence punishable under Sections 498-A, 452, 427, 354, 323, 5O6 read with Section 34 of the Indian Penal Code, 1860 and sections 3 and 4 of the Dowry Prohibition Act,1961, seeking anticipatory bail. The marriage of the de facto complainant and Bathini upended was solemnized at about eight years ago, thereafter they were blessed with two children. Podili Rattamma who is the husband of the de facto complainant was harassing the de facto complainant both mentally and physically, demanding more dowry from her Parental house. On 02.O1.2023 while the de facto Complainant stays at her parents house, husband of the de facto complainant tress passed into the house and abused her in filthy language and beat her, thereby she lodged complaint.

JUDGEMENT

This court was inclined to grant anticipatory bail to the petitioners, however, on Certain conditions. Accordingly, in the event of their arrest  the Petitioners/A.4 (Podili Rattanma) and A.5 (Nayini Durga) shall be released on bail on executing a Personal bond for a Sum Of Rs.1O,OOO/- (Rupees Ten Thousand only) each, with two sureties for the like sum each to the Satisfaction of the arresting police officials and `also on condition that the petitioners shall make themselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to the Prosecution witnesses. The Petitioners shall appear before the station House Officer on every Sunday in between 10.00 A.M., and 5.00 P.M., till filling of Charge Sheet. Accordingly, the Criminal petition was allowed. Miscellaneous applications, if any, pending in this Criminal petition shall stand closed.
