PIL seeking prohibitory order on celebrating B.R. Ambedkar’s birth anniversary simultaneously with a temple festival in a village, dismissed: Madras High Court

The Madras High Court passed a judgement on 13th of April, 2023 in which it directed the police orally to make sure both the events are run smoothly. This was seen in the case of Sivaprakasam v. The District Collector and Ors. and the case was presided over by Acting Chief Justice T Raja and Justice D Bharatha Chakravarthy.

FACTS OF THE CASE:

The petitioner, sought a prohibitory order on celebrating B.R. Ambedkar’s birth anniversary simultaneously with a temple festival in the Pattavarthi village of Nagapattinam district. He contended that in the previous years there have been clashes between the upper-caste Hindus and the members of the Scheduled caste on this day.

The clash mentioned above happened as the upper-caste Hindu people of the village gathered to celebrate a local temple festival and the latter gathered to pay tribute to B.R. Ambedkar on his birth anniversary – both on the same day.

JUDGEMENT:

The court after listening to the contentions, the court dismissed the PIL. It further directed the police orally to make arrangements to ensure that both the events run peacefully. Th learned judges voiced that if even after 75 years of independence if celebrating B.R. Ambedkar’s birth anniversary simultaneously with a temple festival in a village cannot happen, it would not look good on our country.
