Bombay High Court dismiss the appeal by Iran government filed after delay of 12 years : bombay High Court

The Bombay High Court passed a order on 13 March, 2023.This was seen in the case of Islamic Republic of Iran v. KT Steel Industries LLP & Anr. 81 OF 2020 and the case was presided over by Hon’ble Justice  KR Shriram and Rajesh Patil.

 

FACTS OF THE CASE:

In this case Islamic Republic of Iran (IRI) through the Iranian Islamic Republic Railways (RAI) had floated a global tender for purchase of railway wagons. At that point KT steels bids through state trading corporation and entered into a contract with Iranian government on March, 1970 . Due to hike in oil prices there was increase in freight charges. However, KT steels claimed that Iranian government fails to pay freight charges as agreed for 306 wagons in 1973 and 94 wagons shipped in 1977.

 

OREDER OF THE CASE:

The court held, “We observe that the Iranian Government has chosen not to appear before this Court and still refuses to comply with Court’s orders. Applicant (IRI) has not made any submissions before this Court, but only RAI which is not even a party to the Appeal, has engaged a Counsel to appear,” the Court noted.
