Electricity Act, 2003 must be followed in providing new electricity connections: High Court of Delhi

Petitioner is ordered to maintain safe distance between the property /projection and the high tension cable/wire of electricity upheld by the High Court of Delhi through the learned bench led by HON’BLE MR. JUSTICE SANJEEV SACHDEVA in the case of DASPR PIPES PVT LTD vs TATA POWER DELHI DISTRIBUTION LTD (W.P.(C) 3617/2022) on 02nd March, 2022.

Brief facts of the case are that Petitioner seeks a direction to the respondent to provide a new electricity connection on the second floor of Plot No. 284, Pocket-B, Sector-4, Bawana, DSIDC, Delhi. Earlier the electricity connection was refused on the ground that there was certain fibre sheets placed on the roof of the second floor which was within the close proximity of a high tension cable of the respondent running horizontally above the property.

Learned counsel for the respondent submits that the property was once again inspected yesterday and it transpired that certain modifications have been carried out and the fibre sheets have been removed by the petitioner. He further submits that on petitioner filing an affidavit of undertaking with the respondent that they shall not install the fibre sheets again and shall maintain the safe distance as indicated by the officers of the respondent, there would be no objection to the grant of a new electricity connection.

Learned counsel for the petitioner submits that the petitioner shall duly file an undertaking with the respondent within two days.

In view of the above, the Court disposed the petition directing petitioner to comply requirements of the respondent to maintain safe distance between the property  and the high tension cable/wire of the respondent, the Court allows electricity connection be granted in accordance with law.
