Habeas Corpus plea pertaining to Amritpal Singh dismissed as infructuous: Punjab High Court.

The Punjab High Court, on 24th April, 2023, in Imaan Singh Khara v/s State of Punjab and others (CRWP 2757 of 2023 (O&M), dismissed the habeas corpus plea pertaining to Amritpal Singh as infructuous. The judgement was presided by Honourable Mr. Justice N.S. Shekhawat.

FACTS OF THE CASE:

The petition moved a petition under article 226 and registered a habeas corpus case. Under Article 226 of the Constitution, an individual can seek constitutional remedies in the form of writs that are available to protect and safeguard individual rights. Plea was filed by the petitioner after a day of arrest of alleged separatist leader of ‘Waris Punjab De’, Amritpal Singh. Crackdown in the state of Punjab has been in operation since March 18 for the arrest of the aforementioned individual. Imaan Singh Khara, the petitioner is the legal adviser of the outfit. The plea has been moved on the ground that Amritpal Singh was forcefully detailed by the Punjab Police without the authority of law.

JUDGEMENT:

Advocate General, Punjab submitted to the learned bench that the arrest has taken place following the due process of law. Another application where the Union of India was sought to be a respondent was rejected by the bench. Thereby, the court held that, “ In view of the statement made by the learned Advocate General, Punjab, the petition has been rendered infructuous and is dismissed as such.
