Costs of ₹5 lakh imposed on college that cheated 100 students into getting admitted into their college despite not having the appropriate affiliation: Madras High Court
The Madras High Court passed a judgement on 12th of April, 2023 in which it dismissed the petition of a private college that cheated 100 students into getting admitted into their college despite not having the appropriate affiliation. This was seen in the case of Arulmigu Kalasalingam College of Education v. The Appeal Committee, National Council for Teacher Education and Ors. (W.P(MD). No.21747 of 2022 and WMP(MD)No.15915 of 2022) and the case was presided over by The Honourable Mr. Justice C.V. Karthikeyan
FACTS OF THE CASE:
The petitioner, is a private college by the name Arulmigu Kalasalingam College of Education, who is seeking a continuation of affiliation for the years 2021 to 2022 where the affiliation of the college was withdrawn. Hundred students were admitted into the college despite not having the appropriate affiliation.
The petitioner asked the court for the welfare of these students to be taken into consideration so that they could pursue internships and write their exams for the particular academic year.
JUDGEMENT:
The learned single judge after listening to the contentions, dismissed the petition. The court held that college cannot claim ignorance of rules and the requirements of Section 17(4) of the National Council for Teacher Education Act, 1993 in which it clearly states that if a college suffers a withdrawal of affiliation, the certificate or degree given by them would not be considered valid.
The court then directed the petitioner to pay a compensation of ₹5 lakh to the court which would be distributed among the affected students.
