In this case Viacom 18 had approached the court seeking injunction against Internet Service Provider (ISP) for broadcasting the events of IPL 2023 auction whose rights are with Viacom18 given by BCCI for session 2023-2027. The case was Viacom 18 Media Private limited V/S Bharat Sanchar Nigam LTD O.A.Nos.798 & 799 of 2022 in C.S. (common divison) No. 246 of 2022. The case was presided by Mr. Justice C. Saravanan J.
Facts of the cases
- Viacom 18 has been licensed for broadcasting the events for session 2023-2027 by Broad of Control for Cricket in India (BCCI) and has been given a right by BCCI.
- It is submitted that Indian Premier League auction/events which was held on 23.12.22 and the Respondents 1 to 26 in the application being the ISP were likely to broadcast the events/auction of the IPL without any authorization by the applicant. It was also stated that several other people were trying to violate the rights of the plaintiff.
- The applicant made out a prima facie case on the merits to grant of interim relief. The balance of convenience is also in the favour of applicant. No harm will be caused if the interim injunction is granted as prayed by the applicant.
JUDGMENT
The interim injunction was granted by the Madras High Court as it was noticed that in similar case, this same court already granted interim injunction. The applicant was directed by the court to comply with the requirements of order XXXIX Rule 3 of C.P.C.
