Considering all aspects, the prayer for temporary injunction being GA No. 2 of 2022 is disposed of: Calcutta High Court

The above was opined by the Calcutta High Court in the case of In the Goods of Shri Dhirendra Mohan Ojha v. Mukti Ojha and Ors. IA NO. GA/2/2022, which was presided over by the Honourable Justice Apurba Sinha Ray on 8th December 2022. 

FACTS OF THE CASE

The temporary injunction was filed that the daughters of the late testator were being denied entry into the building by the propounder of the alleged Will. It was claimed that he cannot resist or prevent the entry of the daughters into their deceased father’s house. The respondent on the other hand claimed that the will can only be challenged if there were any suspicious grounds which is not the case in the given scenario.

JUDGEMENT OF COURT

The Court after considering all circumstances the prayer for the temporary injunction was disposed of by restraining both parties from preventing or obstructing the entry of the legal heirs of the deceased. This was done on the condition that the parties would adhere to the principles of decency, morality, and mutual obligation.
