A man who allegedly posted a video online depicting the beheading of Nupur Sharma is granted bail: Allahabad High Court.

In the case of Nadeem Ansari v. State of U.P (CRIMINAL MISC. BAIL APPLICATION No.-33710 of 2022), Nadeem Ansari, who is accused of posting a video on Facebook depicting the beheading of former BJP spokesperson Nupur Sharma, has been granted bail by the Allahabad High Court. Justice Deepak Verma’s panel decided to give him bail after carefully reviewing all of the case’s facts, the arguments made by the parties’ attorneys, the evidence, the accused’s complicity, and the greater context of Article 21 of the Indian Constitution.

Facts: Ansari was essentially arrested on June 13, 2022, and charged under Sections 153.A. 295.A, 505 (2) 1.P.C., and Section 67 of the Information Technology Act, 2008 on the grounds that he attempted to stir up racial unrest by posting a video on Facebook and his mobile device depicting the beheading of former BJP spokesperson Nupur Sharma.

He presented the instant ordinary bail request to the court, claiming that the evidence against him is lacking and that he has been wrongfully accused of the purported offence.

Judgement: Next, it was argued that the offence might be tried by the magistrate and that, if he were granted more bail, he would not abuse the privilege and cooperate with the court. As a result, the Court granted him bail in exchange for him providing a personal bond and two sureties, each providing a bond in the same amount that satisfied the relevant court.

In related news, the Rajasthan High Court recently denied bail to a cleric from the Ajmer Sharif Dargah who is accused of inciting protesters and using the chant “Sar Tan Se Juda” at a demonstration over alleged remarks made by former BJP spokesperson Nupur Sharma. Syed Gohar Husain Chisti was denied bail by the Justice Sameer Jain bench, who stated that his release on bail could endanger society at large and have an impact on the state’s law and order situation.
