Court directs old gazettes to be published within six months: Gujarat High Court

This particular decision is upheld by the High Court of Gujarat through the Division Bench of JUSTICE VINEET KOTHARI AND JUSTICE UMESH A. TRIVEDI in the case of Bandish Saurabh Soparkar v. State of Gujarat (R/Writ Petition (Pil) No. 17 of 2021).

Facts:

In the instant case, the petitioner is Bandish Saurabh Soparkar and the respondent is State of Gujarat. The instant petition is filed to direct the Respondents to e-publish on their website all parts of all gazettes published by the State Government to be accessed free of cost and also to make available on their website as much as possible copy of all old gazettes previously published by the State of Gujarat to be accessed free of cost and to provide for the cost of this petition.

Arguments and Judgement:

Government Pleader Ms Manisha Lavkumar Shah, submitted that prayer (a) had already been complied with and the State Government had already started E-publishing all the Notifications issued by the State Government on online method. It was further brought into notice of the Court that as far as the past or old Notifications issued earlier were concerned, such old Gazettes as prayed in prayer (b), the process was underway and the same will be over within a short period. The petitioner however prayed that some time frame may be fixed for that purpose.

The Court allowed the petition and granted prayer (b) with the time framed of six months from then to E-publish old Gazettes also by the State Government compliance report of which must be submitted after six months from the date of the order.
