Bail granted to disabled mother accused of killing newborn: Kerala High Court

The High Court of Kerala, through learned judge, Justice Gopinath P in the case Nisha Suresh v. State of Kerala (BAIL APPL. NO. 274 OF 2022) granted bail to disabled mother accused of killing newborn.

BRIEF FACTS OF THE CASE: The petitioner was the accused in Crime registered at  Kanjirapally Police Station, Kottayam District alleging commission of offence under Section 302 read with Section 34 of the Indian Penal Code.  The allegation against the petitioner was that she along with her elder child aged 15 caused the death of her new born baby who was her 6th child by dropping the baby in a bucket of water. The learned counsel for the petitioner submitted that the allegations were totally false and that the death of the baby occurred on account of an accident by her elder child who bathed the new born baby.

JUDGEMENT: The court took the facts and circumstances of the case at hand and considering the fact that the petitioner was stated to be suffering from multiple disability and that she had been in custody for long  and that her continued detention may not be necessary for the purpose of any investigation, granted bail to the petitioner subject to certain conditions
