“Appellant seeks SEBI Grade A marks before the process of final selection.”: SEBI, Part 1.

The appellate authority under the RTI (Right to Information) Act of the Securities and Exchange Board of India comprising of Mr. Amarjeet Singh adjudicated in the matter of Abhinav Piyush v CPIO, SEBI, Mumbai (Appeal No. 4356 of 2021) dealt with an issue in connection with Section 2 (f) of the Right to Information Act, 2005.

The appellant, Mr Abhinav Piyush had filed an application via RTI MIS Portal on the 10th of June, 2021 under the Right to Information Act, 2005, which SEBI received on the 9th of April. The respondent responded to the application by a letter on the 30th of June, 2021, filed by the appellate. After receiving a letter from the respondent on 30th of June, 2021, on his application, the appellate decided to file an appeal on the 1st of July, 2021.

In his application the appellant was seeking the following information:

  1. The marks scored by the appellant in the mains exams of SEBI Grade A recruitment mains level exam held on 28th February 2021 as well as the cut off of roll no. 1261011810.

The respondent in response to the query, informed that the information sought with respect to marks obtained in Phase II will be displayed on SEBI website after the process of final selection of candidates is completed. Further, the information sought on cut offs of Phase II may be disclosed after the process of final selection of candidates is completed, upon receipt of specific requests under RTI.

On perusal of the appeal, it appears that the appellant is not satisfied with the response provided by the respondent. The appellant filed his appeal on the grounds that it is his right to assess his performance and prepare himself for the future and submitted his appeal.

It was noted that the respondent had categorically stated that the requested information would be displayed on the SEBI website after completion of the process of final selection. It is understood that the recruitment process was not over and pre-mature disclosure might have hindered the ongoing process. In this context, the Hon’ble CIC, in the matter of Shri U.R.M. Raju Vs. Visakhapatnam Port Trust (judgement dated March 09, 2009 in CIC/AT/A/2008/01463).
